Research on the Application and Regulation of Artificial Intelligence in the Field of Public Resource Transactions

摘要

为破解公共资源交易数字化转型中技术赋能与治理适配的核心难题,推动交易效率与公平公正的协同实现,文章基于技术治理理论,结合国内多地实践案例,系统分析人工智能在公共资源交易领域的应用场景、治理风险与监管痛点。研究采用案例分析与逻辑推演相结合的方法,识别数据、算法、主体三个维度的核心风险,剖析现有监管体系的适配性挑战,最终构建“技术赋能-技术规制-主体协同”三维一体的监管框架,并提出标准化建设、算法治理、制度保障等针对性建议。研究结果为公共资源交易数字治理提供了理论支撑与实践路径,助力构建法治化、智能化的公共资源交易生态。

Abstract

To address the core challenge of aligning technological empowerment with governance adaptation in the digital transformation of public resource transactions, and to promote the coordinated realization of transaction efficiency, fairness, and impartiality, this paper, based on the theory of technological governance and in conjunction with practical cases from multiple regions in China, systematically analyzes the application scenarios, governance risks, and regulatory pain points of artificial intelligence in the field of public resource transactions. Using a combination of case analysis and logical reasoning, the study identifies the core risks across three dimensions—data, algorithms, and stakeholders—examines the adaptability challenges of the existing regulatory system, and ultimately constructs a three-dimensional integrated regulatory framework of “technological empowerment–technology regulation–stakeholder collaboration.” It further proposes targeted recommendations in areas such as standardization, algorithm governance, and institutional safeguards. The findings provide theoretical support and practical pathways for the digital governance of public resource transactions and contribute to the development of a law-based and intelligent public resource transaction ecosystem.
