An Exploration of Bid Rigging in Engineering Project Tendering and Bidding and Its Governance Strategies
工程项目招投标串标问题探究及治理策略

摘要

招投标活动是维护公平竞争和合理配置资源的有效机制，而围标串标则破坏了正常的市场环境，导致工程造价提高以及工程质量下降。文章针对工程建设项目的招投标过程展开论述，在此基础上对围标串标的定义、种类、具体形式进行阐述。并且结合企业信用情况、人员道德素质水平、程序设置、信息发布以及监管力度等方面的因素分析原因所在，最后给出相应的解决措施主要有建立行业的信用体制、规范程序、完善监管体系、加大处罚力度。文章的研究发现系统的治理方式有助于减少围标串标现象的发生，同时可以使招投标更加公开透明有序，给工程建设提供制度支持。

Abstract

Tendering and bidding activities constitute an effective mechanism for maintaining fair competition and ensuring the rational allocation of resources. However, collusive bidding and bid rigging disrupt the normal market order, resulting in increased project costs and declining engineering quality. This paper discusses the tendering and bidding process of engineering construction projects and, on this basis, explains the definition, types, and specific forms of collusive bidding and bid rigging. It further analyzes the underlying causes from the perspectives of enterprise credit status, the moral quality of personnel, procedural design, information disclosure, and regulatory enforcement. Corresponding countermeasures are then proposed, including establishing an industry credit system, standardizing procedures, improving the regulatory framework, and intensifying penalties. The study finds that systematic governance measures can help reduce the occurrence of collusive bidding and bid rigging, make tendering and bidding activities more open, transparent, and orderly, and provide institutional support for engineering construction.
