An Analysis of Land Rights Protection and Resettlement Management for Land-Expropriated Farmers in the Process of Land Acquisition and Demolition
征地拆迁过程中土地权益保障与失地农民安置管理问题探析

摘要

征地拆迁既服务于基础设施建设、产业布局优化与城镇空间拓展，也涉及农村集体土地所有权、承包经营权、宅 基地使用权、房屋财产权及集体收益分配权等多重利益。本文以权利保障和生计恢复协同为主线，从权利主体识别、 补偿价值核算、程序参与、安置方式、资金监管与社区融入等方面分析现实问题，构建全周期权利清单、分类分层复 合安置和长效绩效评估机制。研究认为，征地安置应由“补偿支付与按期腾地”转向“权利实现与发展能力恢复”，通 过补偿公开、社保衔接、就业支持和资金监督，保障失地农民原有生活水平不降低、长远生计有保障。

Abstract

 Land acquisition and demolition serve infrastructure construction, optimization of industrial layout, and expansion of urban space, while also involving multiple interests such as rural collective land ownership, contracted land management rights, homestead use rights, housing property rights, and rights to the distribution of collective income. Taking the coordination between rights protection and livelihood restoration as the main line, this paper analyzes practical problems from the perspectives of rights subject identification, compensation value calculation, procedural participation, resettlement methods, fund supervision, and community integration. It constructs a full-cycle rights list, a classified and stratified composite resettlement mechanism, and a long-term performance evaluation mechanism. The study argues that land acquisition and resettlement should shift from “compensation payment and timely land clearance” to “rights realization and restoration of development capacity.” Through compensation transparency, social security connection, employment support, and fund supervision, it is necessary to ensure that the original living standards of land-expropriated farmers do not decline and that their long-term livelihoods are effectively guaranteed.
